Terms and Conditions of Purchase and Privacy Policy

General conditions of purchase for all products and services

Payment methods

  • Any payment, whether a one-off fee or a subscription, may be made by credit, debit or prepaid card, or by bank transfer.
  • In specific cases, payment in Bitcoin may be agreed. In that case the transfer of funds must appear on the blockchain with at least 3 confirmations before the service can be provided or activated.

Responsibility for the use of the information

We cannot guarantee that the information provided during training, consultancy or courses is free of errors, nor that it is understood and applied correctly. Our content is intended solely for training and information purposes and does not constitute financial or investment advice. Any investment decision or, more generally, any use of the information provided through our training, books, written, audio or video content or individual consultancy is therefore your sole responsibility. Any financial gain or loss arising from your actions is for your exclusive benefit and at your exclusive risk.

Nothing in these conditions excludes or limits the statutory rights granted to consumers under applicable law, nor any liability that cannot be excluded or limited by law.

Right of withdrawal

The purchaser has the right to withdraw from the contract, without giving any reason, within 14 days of placing the order or, for subscriptions, of the initial sign-up, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

To exercise this right it is sufficient to send an e-mail to info@gotamcamdamedia.com stating the order details. A full refund will be made without undue delay and in any case within 14 days of receipt of the withdrawal notice, using the same means of payment used for the purchase (card refund or bank transfer), at no additional cost to the purchaser.

For payments made in Bitcoin, unless otherwise agreed with the purchaser, the refund will be made by bank transfer in EUR or GBP, for an amount equal to the value of the price paid at the time of purchase.

The right of withdrawal is lost or limited in the following cases:

  • Digital content (e.g. the lessons of an online course): the right of withdrawal is lost as soon as the purchaser accesses the content, having previously given express consent to the immediate start of the supply and acknowledged that access causes the loss of that right.
  • Individual services (e.g. seminars, one-to-one interactive sessions): where the service has been fully performed with the purchaser’s prior express consent, the right of withdrawal is lost. Where the service has been only partly performed, the purchaser is entitled to a refund of the portion not used.
  • Renewals: the right of withdrawal does not apply to the renewal of a subscription already entered into, occurring through the ordinary running of its term.

“Pass” products

Products named “Pass” are subject to specific contractual conditions. The essential terms (content, duration, price and withdrawal arrangements) are made available to the purchaser before purchase; any operational details are agreed at the time of activation.

Jurisdiction

Any dispute arising from the application, interpretation or performance of these general conditions shall be subject to the jurisdiction of the courts of Manchester, United Kingdom, without prejudice to the mandatory rights granted to consumers by the law of their country of habitual residence, including, where applicable, the right to bring proceedings before the courts of their own domicile.

Data processed and purposes

The Client’s personal data (such as identification, contact and payment data) are processed for the following purposes: managing the relationships needed to deliver the services and/or the professional engagement requested; complying with the resulting administrative, accounting or tax obligations; managing the contacts connected with the service (by telephone, ordinary post or e-mail); and any other purpose necessary to perform the service agreed between the Client and the service provider. We do not process special categories of data (“sensitive data”).

Legal basis for processing

Depending on the purpose, processing is based on: performance of a contract or pre-contractual measures (art. 6.1.b GDPR / UK GDPR); compliance with legal obligations (art. 6.1.c); the legitimate interest of the controller (art. 6.1.f); and the data subject’s consent (art. 6.1.a) where specifically required. Providing the data necessary to perform the contract does not require consent; where consent is required it may be withdrawn at any time, without affecting the lawfulness of processing carried out before the withdrawal.

Method of processing

Processing follows the principles of fairness, lawfulness, transparency, minimisation, relevance and accountability, and is carried out on paper and/or electronic media suitable to guarantee its security and confidentiality, with procedures designed to avoid the risk of loss, theft, unauthorised access, unlawful use, unwanted modification and disclosure. Data are processed by the Controller and by any processors (external suppliers) appointed and strictly authorised, using appropriate technical and organisational measures.

Retention

Personal data are kept only for as long as necessary to achieve the purposes for which they were collected, and are then irreversibly anonymised or securely erased or destroyed. In particular, identification, contact and payment data are kept for as long as necessary to manage contractual and accounting obligations and in any case for 10 years from the end of the contractual relationship.

Data transfers

The Controller is based in the United Kingdom: the data of Clients located in the European Economic Area are therefore transferred to and processed in the United Kingdom on the basis of the adequacy decisions adopted by the European Commission in respect of the United Kingdom. Any further transfers to third countries will take place only with adequate safeguards under arts. 44-49 GDPR and the corresponding provisions of the UK GDPR (for example adequacy decisions or standard contractual clauses).

Cookies and visit statistics

This site consists of static pages and sets no cookies of any kind, neither strictly necessary nor profiling ones. It hosts no advertising, no third-party embedded content and no affiliate links. For visit statistics alone we use Plausible Analytics, hosted on our own server: it records aggregate, anonymous data (page visited, referrer, device type) without cookies, without persistent identifiers and without any information that could identify an individual. For this reason no consent banner is present.

Other sites belonging to the same company may instead use cookies and third-party services: in that case the relevant notice is published on the site concerned.

Rights of the data subject

The Client has the right to:

  • access their personal data;
  • request the rectification, erasure or restriction of the processing of their data;
  • object to the processing on legitimate grounds;
  • request data portability;
  • withdraw consent at any time, without affecting the lawfulness of processing based on consent given before the withdrawal;
  • lodge a complaint with the competent supervisory authority: the Information Commissioner’s Office (ICO) in the United Kingdom (ico.org.uk) and, for data subjects located in Italy, the Garante per la Protezione dei Dati Personali (garanteprivacy.it).
